Postnup.com requires you to hire attorneys for your postnuptial agreement because it can increase the odds of your agreement holding up in court. Postnuptial agreements are generally subject to stricter scrutiny than prenuptial agreements since there is a fiduciary duty between two spouses (there is no fiduciary relationship between two fiances in a prenup). âFiduciaryâ is just a fancy legal term for owing your spouse a higher level of good-faith contract dealing than is required for two people who are not married. For example, one key component of a postnuptial agreement is financial disclosure, and if not done correctly, it can get the postnup tossed. How long does the process take?
On average, the process usually takes about 5-10 business days. The completion time depends on how soon you and your partner complete the guided questionnaire & finalize your agreement with your attorneys.
How much does prenup cost?
Our postnuptial agreements are a flat-rate of $2499 per document. This includes 2 attorneys, one for each party, and e-signature & online notarization.
Do I need to hire an attorney?
Attorneys are recommended for enforceability of the agreement. Postnup.com does not offer postnups without attorneys included.
Which state should I choose?
Generally, you'll choose the state you reside in as a married couple. You can always ask your attorney once you become a Postnup.com paid couple.
Who needs attorney support?
All Postnup.com couples will use attorneys to finalize their agreement once they've completed their individual, guided questionnaires.
