Join waitlist many couples ask... Why do we need attorneys for a postnup? Postnup.com requires you to hire attorneys for your postnuptial agreement because it can increase the odds of your agreement holding up in court. Postnuptial agreements are generally subject to stricter scrutiny than prenuptial agreements since there is a fiduciary duty between two spouses (there is no fiduciary relationship between two fiances in a prenup). “Fiduciary” is just a fancy legal term for owing your spouse a higher level of good-faith contract dealing than is required for two people who are not married. For example, one key component of a postnuptial agreement is financial disclosure, and if not done correctly, it can get the postnup tossed. Attorneys are trained to help you properly value your assets and fill out your financial schedule properly to ensure an enforceable agreement.  By its nature, marriage facilitates a close relationship where taking advantage of one another is easier than it would be if you weren’t already married.  When both spouses hire attorneys for their postnup, it makes it much harder for one spouse to later argue that they didn’t understand the agreement and/or that they didn’t voluntarily enter into the agreement. Now, it is not to say it’s not possible for a postnuptial agreement to hold up without legal representation; it’s just riskier, given the stricter scrutiny applied to postnups than to prenups.  Our Philosophy: ‍ At Postnup.com , we believe that hiring counsel for your postnup is in the best interest of both spouses because it protects both sides, strengthens the enforceability of the agreement, ensures proper execution and financial disclosure, and significantly reduces the risk that the agreement could later be overturned in court. It's not what people think it is. For me it's like, I love you enough that if something really bad were to happen, I am not going to come for anything that you have worked for to earn in this world. And I respect you enough to not take the things that you have earned. That's literally all it is. It's love and respect put on paper. Postnup.com made it so easy to actually get it done instead of just talking about it." Kat G. "We weren't even sure we were going to get married, but we were building a house so everything just happened fast. We decided in August, married in September, closed in October. I'm usually very well researched so that was kind of a lapse in my character to not get a prenup. Definitely had prenup FOMO after the fact. Then I found postnup.com and honestly, thank god. It was exactly what I didn't know I needed. All that stress I'd been carrying about not getting a prenup is totally gone. If you missed the prenup window, don't spiral about it. Just use postnup.com and you're good." Molly C. "I saw firsthand how messy things got when my parents split without a prenup, and it put them both in a really uncomfortable position. After that, I pretty much knew from a young age that if I ever got married, I wanted that kind of security. I look at it like an insurance policy...you hope you never have to use it, but if you do, at least it's fair. We actually started talking about it before we were even engaged. That's how important it was to us. Postnup.com just made it easy to actually follow through without all the stress and the back and forth." Jeremy W. Am I required to add attorney representation?

It depends on your state. Some states, like Alabama, West Virginia, and South Carolina, require attorney involvement, while others, such as California, only require it specifically if addressing spousal support. New York only requires attorneys if you add in embryo disposition clauses.

Even if your state doesn’t require it, having attorney representation offers plenty of benefits. Not only can it increase the likelihood of the agreement holding up in court if challenged, but it also ensures you receive expert legal advice and a clear understanding of your rights and obligations.

Who needs Attorney Representation?

Whether or not you need attorney representation varies from state to state. For instance, while Alabama, West Virginia, and South Carolina generally require attorney involvement, other states have different rules. In California, you’ll need an attorney only if your agreement addresses spousal support, while in New York, it’s necessary if you include clauses about embryo disposition. It’s important to understand the specific laws governing prenuptial agreements in your state to ensure your agreement is valid and enforceable.

Which attorney should I choose?

In HelloPrenup, choosing a lawyer for your prenuptial agreement is a straightforward and effective process. We start by understanding your specific needs and geographic location to provide you with a list of highly qualified lawyers in your area. You can review lawyers’ profiles, and read reviews from other clients. Furthermore, all the lawyers on our platform specialize in prenuptial agreements and family law, giving you the peace of mind that you are working with experts in the field. Our platform simplifies the selection of a lawyer for your prenuptial agreement, providing you with all the tools and information you need to make the best decision.

What can Attorney Representation help me with?

Once you’ve created your prenup draft with HelloPrenup, your selected attorney can provide personalized legal guidance and support. They can answer your questions, suggest minor adjustments to the document, conduct a thorough review, and ultimately ensure your agreement is tailored to you and ready for signing.

How quickly can I get representation?

Very quickly! Most of our independent attorneys have next-day availability for an attorney representation call. Some even offer weekend availability. They are independent attorneys, so all of their calendars may differ. You must book your representation call after your prenup has been generated so the attorney may review your document before meeting.

When do I start Representation?

You can purchase representation at any stage in the prenup process. However, scheduling an attorney meeting and conducting the representation session should happen after your prenup draft has been generated in the HelloPrenup platform. This allows the attorney to review the document before meeting with you.

When do I pay for Representation?

You can pay for representation at any point during the prenup process. However, it’s best to make the payment once your prenup draft has been generated. After payment, you can schedule a meeting with an attorney to discuss the document, allowing them to review, suggest modifications if necessary, and sign the agreement.

Can one attorney represent both of us if we agree on everything?

No, unfortunately not. One attorney cannot represent both fiancés because it creates a conflict of interest.

Will the attorney review my prenup before my representation appointment?

Yes! If you purchase attorney representation, your attorney will review your generated prenup before your 1-hour consultation. During your consultation, you can discuss any questions you may have about the agreement and any desired customizations.

If my representation attorney needs to communicate with my fiancé’s representation attorney, will this increase the cost?

No, it will not! The attorney representation fee is a flat-fee, not an hourly rate. It includes three rounds of document revisions and communications with opposing counsel as necessary.

How much time does the attorney have to finish the revisions?

The average turnaround time is 3 business days. The typical range is between 1 and 7 business days. This timeframe can vary based on the level of requested edits that either fiancé may have for their respective attorneys.

If I hire representation, does my fiancé have to hire representation as well?

Not necessarily! Assuming you reside in a state that does not require attorney representation for both fiancés, one fiancé can hire an attorney and the other can decide to waive attorney representation.
